Terms of Service

Agreement to Terms

By accessing and using the Draft to Shelf website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Use License

Permission is granted to temporarily access our services for personal, non-commercial use only. This license shall automatically terminate if you violate any of these restrictions.

You may not:

  • Modify or copy our materials without permission
  • Use the materials for any commercial purpose or public display
  • Attempt to decompile or reverse engineer any software on our website
  • Remove any copyright or proprietary notations from materials
  • Transfer the materials to another person or mirror on any other server

Publishing Services Agreement

Service Delivery

Draft to Shelf agrees to provide publishing services as outlined in individual service agreements. We commit to:

  • Deliver services within agreed-upon timelines
  • Maintain professional standards in all work products
  • Communicate regularly about project progress
  • Provide revisions as specified in service packages

Client Responsibilities

Clients agree to:

  • Provide necessary materials and information in a timely manner
  • Respond to queries and review requests within reasonable timeframes
  • Make payments according to agreed-upon schedules
  • Own or have rights to all content submitted for publication

Intellectual Property Rights

You retain full ownership and all intellectual property rights to your manuscript and content. Draft to Shelf claims no ownership or rights to your work. We may request permission to use your book cover or other materials for portfolio and marketing purposes.

Payment Terms

Pricing and Payment

  • All prices are quoted in US Dollars unless otherwise specified
  • Payment schedules are outlined in individual service agreements
  • We accept payment via credit card, PayPal, and bank transfer
  • Prices are subject to change with 30 days notice

Refund Policy

Refunds are handled on a case-by-case basis. Generally:

  • Full refunds available if services have not commenced
  • Partial refunds may be available based on work completed
  • No refunds once final files have been delivered and approved
  • Disputes will be resolved through good-faith negotiation

Service Modifications

We reserve the right to:

  • Modify or discontinue services with reasonable notice
  • Update pricing for new clients
  • Refuse service to anyone for any reason
  • Change these terms with appropriate notification

Limitation of Liability

Draft to Shelf shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for services rendered.

Disclaimer

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee specific sales results, rankings, or success metrics for published books.

Third-Party Services

We work with third-party platforms (Amazon KDP, Apple Books, etc.) for distribution. We are not responsible for changes in their terms, policies, or availability. Clients must comply with all third-party platform requirements.

Confidentiality

We maintain confidentiality of all client materials and information. We will not share, publish, or distribute your work without explicit permission, except as necessary to fulfill contracted services.

Termination

Either party may terminate services with written notice. Upon termination:

  • Payment is due for all work completed to date
  • All client materials will be returned or destroyed
  • Outstanding deliverables may be completed at our discretion

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

  • Good-faith negotiation between parties
  • Mediation if negotiation fails
  • Binding arbitration as a final resort

Governing Law

These terms are governed by the laws of the State of New York, United States, without regard to conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of modified terms.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
